Agreement to Offer Disney Vacation Club Points for Rental

This Agreement is made by and between [Member's Full Name] ("DVC Member") and DVC Rental Experts ("Intermediary" or “DVC Rental Experts”).

The DVC Member requests assistance from the Intermediary to secure guests for point rentals in exchange for an agreed price per rented point, payable to the DVC Member, and an agreed commission per rented point, payable to the Intermediary.  

Both parties acknowledge that they are familiar with Disney Vacation Club (DVC) terminology, operations, rules, and regulations, and will not rely on each other for guidance regarding Disney policies and procedures.

1. Points Available for Rental

• The DVC Member agrees to make the points listed below available for rental through DVC Resale Experts.
• The Intermediary is not responsible for any points that are not rented or expire before being used.
• This Agreement remains in effect until all available points are rented or the rental “use year” ends. A new Intermediary Agreement may be executed by the parties thereafter if all available points are rented or the rental use year has ended.

2. DVC Rental Experts' Responsibilities

DVC Rental Experts agrees to:

• Secure guests interested in renting DVC points, as available to the Intermediary.
• Check availability with Disney Vacation Club Member Services.
• Communicate with the DVC Member regarding guest requests.
• Collect funds from the guest and finalize the rental agreement.
• Pay the DVC Member as follows:
  
  • 70% of the total payment once the reservation is confirmed and full payment is received from the guest.
  • The remaining 30% within 7 days after the guest checks in.
• Ensure reservations are confirmed for the guest.
• Provide DVC Member with credit card or other financial information from the guest if optional add-ons (dining plans, ticket packages) are requested, allowing the DVC Owner to process them directly with Disney. 

3. DVC Member's Responsibilities & Commitments

The DVC Member agrees to:

• Provide accurate details regarding the number of points available for rental, including home resort, use year, and any banked or borrowed points.
• Keep all DVC financial obligations current to prevent reservations from being canceled, including:
  
  • DVC Membership dues
  • Any applicable mortgages
• Ensure their DVC Membership remains active so that all reservations are honored.
• Will not sell their membership prior to any upcoming rental reservations. 
• Confirm reservations with Disney Vacation Club and send confirmation details to the Intermediary within 24 hours.
• Process guest add-ons (dining plans, room requests, etc.) and provide confirmation to the Intermediary for guest records.  
• Maintain an active PayPal or Zelle account to receive payments (if electronic payment is preferred rather than a check). The DVC Member is responsible for staying informed about PayPal’s terms and policies. 

• Not to list these points for sale or rent elsewhere during the rental term.
• To honor all reservations for which funds have been collected.

If the DVC Member cancels a reservation or fails to comply, they agree to fully reimburse DVC Resale Experts and the guest for any losses, including:

• Costs associated with rebooking
• Legal fees or other related expenses

The DVC Member also agrees to indemnify DVC Resale Experts against any claims, losses, or damages resulting from the Member's failure to fulfill their obligations.

4. An Act of God or an Uncontrollable Event

In the event of an act of God or other uncontrollable event, including but not limited to natural disasters (such as hurricanes, floods, earthquakes, or fires), government mandates or restrictions, acts of terrorism, war, civil unrest, labor strikes, pandemics or epidemics, supply chain disruptions, transportation shutdowns, utility outages, cyberattacks or system failures, widespread power outages or internet disruptions, sudden changes in laws or regulations affecting performance, or Disney Vacation Club closures, each party is excused from future performance under this agreement without liability or penalty.

If DVC Resale Experts has paid 70% of the rental funds to the DVC Owner, the DVC Owner must return the full amount received as soon as reasonably possible if the reservation cannot be honored.

5. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida. Any disputes shall be resolved in the courts of Orange County, Florida.
